Insurance

R&G has one of the strongest and most experienced insurance litigation practices in the country. We have brought and defended cases in courts and arbitral proceedings throughout the United States, London and Bermuda on behalf of our clients. Our insurer clients have repeatedly chosen Ropes & Gray to plan, coordinate and handle major coverage problems across a broad array of businesses, including natural catastrophes, September 11, first-party environmental clean-up, asbestos-in-buildings, Y2K, lawyers’ tax shelters, American railroad liability, third-party liability claims, directors & officers claims and London arbitrations.

Our insurance practice is headquartered in Boston and New York with lawyers handling major claims and cases throughout the country. We also maintain a conference center in London.

What have we done lately?
  • Serve as lead counsel to London and Bermuda insurers in responding to the largest set of property claims in insurance history, including winning a jury verdict for Lloyd's and other European insurers in the 9/11 attack on the World Trade Center insurance coverage litigation. As a result of the victory the firm was honored by the Chairman of Lloyd's, Lord Levene, for exceptional service. For a description of an associate's role in this matter, click here. In early 2008, Ropes & Gray obtained another successful result for our clients, winning a summary judgment ruling confirming that the Port Authority of New York and New Jersey is not entitled to pursue a second round of insurance payments — potentially totaling $1.5 billion or more — for the World Trade Center property it leased to developer Larry Silverstein shortly before 9/11.
  • Represented Certain Underwriters at Lloyd's, London and companies in the London insurance market in the defense of a bad faith claim for hundreds of millions of dollars in state court in Ohio. For a description of an associate's role in this matter, click here.
  • Act as coordinating counsel for the London insurance market on property insurance claims arising out of Hurricane Katrina, including the representation of London insurers in dozens of individual commercial property claims. The claims present novel issues with respect to wind/flood allocation and exclusions and business interruption. For a description of an associate's role in this matter, click here.
  • Represent U.S. based insurer in an action brought in federal court in Ohio in which the insured seeks to rescind a policy buyout agreement between the parties. For a description of an associate's role in this matter, click here.
  • Represented first-party property insurers in connection with a claim for physical damage and business interruption as a result of mold at Hilton's Kalia Tower property in Hawaii. For a description of an associate's role in this matter, click here.
